3. The War Cabinet had before them a Memorandum by the Secretary of State for Foreign

territoriality. Affairs (W.P. (42) 448) covering

(1) A letter from the American Ambassador.

(2) The draft of a Treaty between the United

States Government and China relating to Extra-territorial jurisdiction.

(3) The instructions from the State Department

relating to the Treaty, which the Ambassador had received from the State Department.

THE SECRETARY OF STATE FOR FOREIGN AFFAIRS said that the immediate proposal was that the British and American Governments should inform the respective Chinese Ambassadors, on the 9th October, that their Governments expected to present to the Chinese Government in the near future, for its consideration, draft Treaties the conclusion of which would relinquish extra- territorial rights in China. The American Government proposed that this intimation should be given privately.
